Key Changes to the AMPS Regime 2010-03-04

The Canada Border Services Agency has announced key changes to the Administrative Monetary Penalty System (AMPS) following a fundamental review.
 
Phase 1 of these changes will be implemented in April, 2010. The changes in this initial phase include:
  • A new penalty amount structure, based on risk;
  • New penalty amounts; and
  • A 30-day delay in the escalation of certain penalty amounts
Importers are encouraged to review this table listing current and revised penalty amounts.
 
Several contraventions under the current AMPS regime are structured according to a graduated amount or a percentage of the value for duty, whichever is greater. Most of the “percentage of value for duty” provisions have been eliminated, leaving a graduated amount based on whether it was a first, second, third, or subsequent occurrence. Many of these graduated penalty amounts have increased.
